AN ANNUAL AGREEMENT WITH THE CALIFORNIA DEPARTMENT OF JUSTICE BUREAU OF
NARCOTIC ENFORCEMENT FOR A HIGH INTENSITY DRUG TRAFFICKING AREA PROGRAM AND
ADOPTION OF RELATED APPROPRIATION ORDINANCE AND FUNDING SOURCES RESOLUTION
AMENDMENTS IN THE GENERAL FUND TO INCREASE THE POLICE DEPARTMENT’S PERSONAL
SERVICES FOR EXPENSES RELATED TO THE AWARD
COUNCIL DISTRICT: City-Wide
1. Adoption of a resolution accepting an award from the Office of National Drug Control Policy for a High Intensity Drug Trafficking Area (HIDTA) program in the amount of $52,668.
2. Approval of an annual agreement with the California Department of Justice (DOJ) Bureau of Narcotic Enforcement (BNE) for continuation of the South Bay High Intensity Drug Trafficking Area (HIDTA) Task Force for the period of January 1, 2001, through December 31, 2001, in the amount of $19,038.
3. Adoption of related amendments to the Appropriation Ordinance and Funding Sources Resolution in the General Fund for sworn overtime is proposed as follows:
A. Increase the Police Department’s Fiscal Year 2000-01 Personal Services appropriation by $71,706.
B. Increase the Fiscal Year 2000-01 revenue estimate from the Federal Government by $71,706.
BACKGROUND
Many cities in the United States are experiencing substantial drug use problems, but large-scale drug trafficking activities found in certain areas are the source of much of the nation’s drug supply. Section 1005 of the Anti-Drug Abuse Act authorizes the Director of the Office of National Drug Control Policy to designate certain localities of the United States as High Intensity Drug Trafficking Areas (HIDTAs). The goal of the HIDTA program is to take concerted action in these designated areas to identify and dismantle drug trafficking organizations, thereby alleviating the drug problem throughout the entire nation.
As the gateway to the Pacific Rim, the San Francisco Bay Area plays a pivotal role in any successful nationwide drug control strategy. Designating the Bay Area as a HIDTA gives local, State, and Federal agencies (law enforcement, treatment, and education) the resources needed to combat this most critical drug trafficking problem.
After a locality has been designated
a HIDTA by the Office of National Drug Control Policy, one of the tools
utilized to confront specific drug problems is the establishment of
multi-jurisdictional law enforcement task forces. Subsequently, HIDTA has established the South Bay Methamphetamine
Task Force, comprised of several South Bay Area law enforcement agencies.
Per the adopted HIDTA budget plan, San Mateo County (as the implementing agency) will reimburse the San Jose Police Department overtime expenses up to $71,706 for sworn officers’ overtime. Of the $71,706, up to $19,038 will fund overtime for two San Jose Police officers assigned to the South Bay Methamphetamine Task Force (SBMTF), and up to $52,668 will fund overtime for San Jose Police officers investigating narcotics related crimes occurring within the San Jose city limits.
The contract agreement is retroactive to January 1, 2001. The late request to approve the agreement and the appropriation for this project is the result of an unforeseen delay in receiving the required Memorandum of Agreement from the Federal Government.

This agreement has been coordinated with the Manager’s Budget Office and the City Attorney’s Office.
The total costs of the overtime expenses will be reimbursed by the HIDTA award. There is no cash match or in-kind match required by the City.
